1. Acceptance of Terms

These Terms of Use (“Terms”) govern access to and use of the website, mobile application, and related services (collectively, the “Platform”) operated by the Company (“the Company”, “we”, “our”, or “us”).

The Platform allows users to browse menu items, place food orders, and arrange delivery from the Company’s owned and operated restaurants located in Dubai, United Arab Emirates.

By accessing or using the Platform, creating an account, or placing an order, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

If you do not agree with these Terms, you must immediately stop using the Platform.

These Terms constitute a legally binding agreement between you and the Company under the laws of the United Arab Emirates.


2. Eligibility and User Accounts

2.1 Eligibility

To use the Platform, you must:

  • be at least 18 years old

  • have legal capacity to enter into binding agreements

  • be located within the United Arab Emirates

By creating an account or placing an order, you confirm that you meet these requirements.

2.2 Account Registration

Users may create an account by providing certain personal information, including:

  • full name

  • phone number

  • email address

  • delivery address

  • payment information

You agree to provide accurate and complete information and to keep such information up to date.

2.3 Account Security

Users are responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account.

The Company shall not be responsible for any loss resulting from unauthorized access to your account.


3. Ordering and Delivery Process

3.1 Food Orders

The Platform enables users to order food and beverages prepared by the Company’s restaurants.

Orders may be placed through the website or mobile application.

Once an order is placed and confirmed by the Platform, it becomes binding.

3.2 Order Confirmation

After placing an order, users will receive confirmation through the Platform or via email or SMS.

The Company reserves the right to reject or cancel orders in cases such as:

  • item unavailability

  • technical errors

  • suspected fraudulent activity

  • inability to complete delivery

3.3 Delivery Service

Food delivery is provided by the Company or by authorized delivery partners.

Delivery times displayed on the Platform are estimates only and may vary depending on:

  • restaurant preparation time

  • traffic conditions

  • weather conditions

  • operational circumstances.


4. Payments and Pricing

4.1 Payment Methods

The Platform supports online payments including:

  • credit cards

  • debit cards

  • other approved digital payment methods.

Payments are processed through secure and licensed payment service providers compliant with applicable UAE regulations.

4.2 Pricing

Prices listed on the Platform may include:

  • the price of food items

  • delivery fees

  • service charges

  • applicable Value Added Tax (VAT) under UAE law.

All prices are displayed in the applicable currency and may change without prior notice.

4.3 Payment Authorization

By submitting payment details, you authorize the Company or its payment processors to charge the full amount of your order.


5. Cancellations and Refunds

5.1 Order Cancellation

Orders may only be canceled within a short period after placement and before food preparation begins.

The Company may cancel an order if:

  • payment cannot be processed

  • delivery is not possible

  • items are unavailable

  • technical errors occur.

5.2 Refunds

Refunds may be issued in circumstances including:

  • order cancellation

  • failure to deliver the order

  • incorrect or incomplete orders.

Refunds will generally be processed using the original payment method unless otherwise required by law.

Processing time may depend on the payment provider.


6. Food Information and Allergies

The Company strives to ensure that menu descriptions and ingredient information are accurate.

However, users with food allergies or dietary restrictions are advised to review menu information carefully before placing an order.

While the Company takes reasonable precautions in food preparation, cross-contamination may occur.


7. User Conduct

Users agree not to:

  • use the Platform for illegal activities

  • provide false or misleading information

  • attempt to interfere with the Platform’s functionality

  • attempt unauthorized access to systems or data

  • abuse or harass employees or delivery personnel

  • engage in fraudulent payment activity.

Violation of these rules may result in suspension or termination of access to the Platform.


8. Intellectual Property

All content available on the Platform, including but not limited to:

  • software

  • logos

  • trademarks

  • design

  • graphics

  • text

is owned by the Company or its licensors and is protected under applicable intellectual property laws.

Users may not reproduce, distribute, or exploit any Platform content without prior written consent from the Company.


9. Limitation of Liability

To the maximum extent permitted under UAE law, the Company shall not be liable for:

  • indirect or consequential damages

  • loss of profits or data

  • delays in delivery

  • temporary interruptions of the Platform.

The Company’s total liability for any claim relating to the use of the Platform shall not exceed the total amount paid by the user for the relevant order.


10. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, employees, and partners from any claims, damages, liabilities, or expenses arising from:

  • your misuse of the Platform

  • violation of these Terms

  • violation of applicable laws.


11. Suspension or Termination of Accounts

The Company reserves the right to suspend or terminate user accounts if:

  • these Terms are violated

  • fraudulent activity is suspected

  • the Platform is used in a manner that may harm the Company or other users.

Users may request deletion of their account by contacting customer support.


12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.

Any disputes arising from these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.


13. Changes to Terms

The Company reserves the right to update or modify these Terms at any time.

Updated versions will be published on the Platform with the revised effective date.

Continued use of the Platform constitutes acceptance of the updated Terms.
